RE: The tariff classification of a women’s quilted short coat from China

Dear Ms. Wong:

In your letter dated June 12, 2008, you requested a classification ruling. A sample was submitted and is being returned as you requested.

The item in question, style PP 1070165, is an outerwear garment with a shell made from a woven 100% polyester fabric quilted to a nonwoven batting. The garment has long sleeves with hidden elasticized cuffs, a front zipper covered by a three-snap closure, a deep V-neck with a fake fur shawl collar, welted pockets with zipper closures in the front, a full lining, exposed decorative stitching on the front panels and a hidden elastic drawstring with a cord lock in the center back.

The applicable subheading for the coat will be 6202.13.4020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other women’s overcoats, carcoats, capes, cloaks and similar coats, of man-made fibers. The duty rate will be 27.7 percent ad valorem.

This coat falls within textile category 635. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
